They are most likely fruit flies.  I have had this problem before and it sucks because those little buggers can survive off of what seems like nothing.  Put any fruit, bread, other open edibles in the fridge and put your house plants outside.  Clean all the countertops and the sink with a cleaner that includes bleach (don't forget the sink, the flies can live off of fumes coming from the disposal even if you do not smell anything).  The flies have a very short life span (about 3 days) so after about a week (incase of any eggs) you can bring the house plants back in and put fruit and bread back out of the fridge.  This usually works for us.
